Synopsis
Multinational Corporations operating in conflict areas are often found complicit for international crimes such as War Crimes, Crime against Humanity, and Genocide committed by armed groups. This Book tries to assess corporate criminal responsibility for complicity in international crimes in Africa by taking the case of DRC as a demonstration. It analyzes the conceptual framework on criminal responsibility of complicit Corporations for international crimes. It addresses the basic question of establishing criminal responsibility against fictitious entities. The challenges and prospects of prosecuting complicit corporations under domestic criminal laws, the African Court of Justice and human rights, and the International criminal Court international has been deeply analyzed. Lastly, the Book suggests for the clear inclusion of corporate criminal responsibility under the Congolese law and the Rome Statute. It also suggests the consolidation of corporate criminal responsibility under the Protocol of the African Court of Justice and Human rights.
